Why Hasn’t He Proposed? Sweepstakes Official Rules

 

No Purchase Required to Enter or Win, Purchase will not increase entrant’s chances of winning
 

Eligibility: No purchase necessary.  The Why Hasn’t He Proposed? Sweepstakes (the "Sweepstakes") is open only to legal residents of the 48 contiguous United States (excluding Hawaii and Alaska) who are eighteen (18) years of age or older at the time of entry, are not already married (as the term 'married' is legally defined in entrant's home state) and must be prepared to possibly propose on live television or in another media format – radio/internet on February 14, 2009.  Employees of DMTM, LLC, or other companies associated with the promotion of the Sweepstakes, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible.  The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited by law.

 

Sponsor: The Sweepstakes is sponsored by DMTM, LLC, 321 Millburn Avenue, Suite 11, Millburn, New Jersey, 07041 (the "Sponsor").

 

Agreement to Official Rules: Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

 

Entry Period: The Sweepstakes begins on December 1, 2008 at 12:00:01 A.M. Eastern Time ("PT") and ends on February 13, 2009 at 11:59:59 P.M. ET (the "Entry Period"). Entries submitted prior to or after the Entry Period will be disqualified. Administrator’s computer is the official time keeping device for the Why Hasn’t He Proposed? Sweepstakes.  Winners will be notified by e-mail and/or telephone within (7) days of the drawing to take place Saturday, February 14, 2009.

 

Entry: Visit www.perfectfind.com and follow the links to the Sweepstakes page. Complete the online entry form and submit.  Include a valid email and postal address.  There is a limit of one (1) entry per person and e-mail address.  Subsequent entries will be void.  Any entries attempted through the use of agencies or robotic, repetitive, automatic, programmed, or similar methods will also be void.  All potential winners are subject to verification before any prize will be awarded.  If any dispute arises as to identity of entrant, entrant shall be considered person who owns Internet account through which entry was submitted.  

 

TELL A FRIEND:  After you enter the Why Hasn’t He Proposed? Sweepstakes, you may be invited to submit the names and email addresses of friends who must be eligible to enter into the Why Hasn’t He Proposed? Sweepstakes.  Each person that you refer will receive an email notifying them about the Why Hasn’t He Proposed? Sweepstakes.  You may only refer persons with whom you have an existing relationship.  

 

Drawing: On or about February 14, 2009 the Sponsor will select the name of one (1) potential winner in a random drawing of all entries received at the time of the drawing for the Grand Prize; one (1) potential winner in a random drawing of all entries received at the time of the drawing for the Second Prize; and (5) potential winners in a random drawing of all entries received at the time of the drawing for the Third Prize.  The Sponsor will select the names of the potential winners in a random drawing of all entries received. The odds of being selected depend on the number of eligible entries received.  The Sponsor will attempt to notify the potential winners within seven (7) days of the drawing.  If a winner is determined to be ineligible, cannot be reached within a reasonable amount of time, or otherwise fails to comply with Sweepstakes Rules, that entrant shall be disqualified and another winner will be selected at random from among all remaining eligible entries. 

 

Requirements of Potential Winners: Except where prohibited, the potential winners may be required to complete and return an affidavit of eligibility and liability/publicity release (the "Affidavit/Release") within seven (7) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, an alternate entrant will be selected in his/her place in a random drawing of all entries received.

 

Prizes: The Grand Prize winner will receive one Cushette style platinum engagement ring.  The Second Place prize winner will receive one pair of diamond earrings.  The six Third Place prize winners will each receive one autographed copy of the book Why Hasn’t He Proposed?.  Prizes are nontransferable and non-refundable and must be accepted as awarded.  No cash or other substitution may be made, except by Sponsor, who reserve the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by Sponsor in their sole discretion. If any prize becomes unavailable for any reason, Sponsor reserves the right to substitute a prize of comparable value.  The winner is responsible for taxes and all other costs and expenses not listed above.  Approximate Retail Value: $4000 for Cushette diamond ring, $350 for diamond earrings, and $12.00 per copy of the book. 

 

General Conditions: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prizes at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the participant. The "authorized account holder" is the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

PUBLICITY: Except where prohibited, participation in Why Hasn’t He Proposed? Sweepstakes constitutes winner's consent to Sponsor’s use of winner's name, likeness, photograph, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.

 

Release and Limitations of Liability: By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, its related companies, and their respective officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt of any prize; (h) any incorrect or inaccurate information, whether caused by entrants, or by any of the equipment or programming associated with or utilized in the Why Hasn’t He Proposed? Sweepstakes; or (i) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Why Hasn’t He Proposed? Sweepstakes or receipt or use of any prize or while traveling to or from any prize-related activity.  Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

 

Disputes: Except where prohibited, entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Why Hasn’t He Proposed? Sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for New Jersey; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Why Hasn’t He Proposed? sweepstakes but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with Why Hasn’t He Proposed? Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the State of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New Jersey.

Requests must be received by February 28, 2009. Vermont residents may exclude return postage for Rules requests.
